1. Sale and Delivery

• The point of sale and delivery is deemed to occur at the business premises of Yellow Metal SA Pty (Ltd).
• Ownership of goods remains with Yellow Metal SA Pty (Ltd) until full payment is received.
• Quotations are valid for the period specified in the quote, subject to stock availability.
• Delivery, courier, and freight charges are not included in the quotation unless expressly stated.

2. Orders and Payments

• Orders will only be processed once full payment has been received and cleared in our bank account. No orders will be processed without 100% payment.
• All payments must be made in South African currency, and payments are due by the end of the month following the delivery of goods, unless otherwise agreed.
• Payment of the invoice constitutes acceptance of these Terms and Conditions.

3. Returns and Refunds

• Parts and equipment must be checked for correctness upon delivery or collection.
• Non-refundable Items:
  • Parts supplied correctly.
  • Electrical parts/components (unless covered by a manufacturing fault).
  • Used parts (unless specified in the supplier's warranty).
  • Special orders or imported goods.
• Returns will only be accepted within 14 days of delivery, at the purchaser's expense. The goods must be in original packaging and condition and not fitted.
• A handling fee of 30% of the value of returned goods will apply.
• Electrical components are only covered for manufacturing faults, and refunds will not be granted for defects.

4. Warranties

• Parts supplied by Yellow Metal SA Pty (Ltd) carry a standard 3-month or 500-hour warranty, subject to inspection and testing.
• No warranties are provided unless explicitly stated on the invoice.
• Electrical components are covered for manufacturing defects only and will not be refunded.
• Warranty claims will be assessed upon return of the defective goods, and the cost of return is the responsibility of the purchaser.

5. Delivery and Risk

• Once goods are in possession of the carrier (chosen by the purchaser or Yellow Metal SA Pty (Ltd)), the risk passes to the purchaser.
• We are not responsible for any transport, courier, delivery, or freight charges, and these charges are non-refundable.

6. Liability and Limitations

• Yellow Metal SA Pty (Ltd) is not liable for any loss, damage, injury, or death, whether direct or consequential, arising from the use of goods or equipment purchased from us.
• We are not responsible for any failure to perform our obligations due to events beyond our reasonable control (e.g., natural disasters, strikes, or delays).

7. Title and Repossession

• Ownership of the goods remains with Yellow Metal SA Pty (Ltd) until the full purchase price has been paid.
• If the purchaser faces insolvency, bankruptcy, or any legal proceeding, Yellow Metal SA Pty (Ltd) reserves the right to repossess goods.

8. Repairs and Modifications

• Any repairs, dismantling, or adjustments carried out by unauthorized parties or the fitting of parts other than those supplied by Yellow Metal SA Pty (Ltd) during the warranty period will void the warranty.

9. Dispute Resolution

• Any disputes arising from these Terms and Conditions will be governed by the laws of South Africa. Yellow Metal SA Pty (Ltd) reserves the right to institute legal action in the Magistrate’s Court.
• In the event of a breach of contract by the purchaser, Yellow Metal SA Pty (Ltd) may cancel the contract and demand immediate payment of any outstanding amounts.

10. Changes to Terms and Conditions

• Yellow Metal SA Pty (Ltd) reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on this page, and it is the responsibility of the purchaser to review these Terms regularly.
